Housing: Deposit Withheld / Repairs Ignored

As a tenant, you have legal rights. Landlords cannot arbitrarily keep your security deposit, and they must address health and safety issues. Follow these steps to protect yourself and recover what you're owed.

Review your lease agreement

Check what the deposit covers, repair responsibilities, and lease terms about deposits and repairs.

Document everything with photos and dates

Take photos/videos of damage, needed repairs, move-in condition (if possible), and move-out condition.

Request deposit return in writing

Send a formal letter requesting your deposit back. In BC, landlords have 15 days after receiving your forwarding address to return the deposit or provide an itemized statement of deductions.

Request repairs in writing

Send dated, written requests for repairs. Keep copies. This creates a legal paper trail and may be required for RTB disputes.

Review BC Residential Tenancy Act

Understand your rights under BC's Residential Tenancy Act regarding deposits, repairs, and landlord obligations.

Send a demand letter

If landlord doesn't respond, send a formal demand letter giving a deadline before filing with RTB.

File with Residential Tenancy Branch (RTB)

If deposit is wrongfully withheld or repairs aren't made, file a dispute application with RTB BC. There is a filing fee, but you may recover costs if you win.
